Affiliate Terms and Conditions

1. Agreement

These terms govern participation in the Empowered Maths Affiliate Program operated by Katrina Mardell (we, us or our). By joining, creating an affiliate link or promoting Empowered Maths as an affiliate, you agree to these terms. These terms are separate from the Membership Terms that apply if you also hold a membership.

2. Eligibility and enrolment

You must be at least 18, provide accurate contact and payment details, use a verified Empowered Maths account and accept these terms. Members and non-members may apply. A non-member may create a free account for affiliate access without purchasing a membership.

We may refuse an application where reasonably necessary to protect the program, customers or brand. Participation does not create an employment, partnership, franchise, agency or joint venture relationship.

3. Affiliate links and attribution

You receive a unique link after enrolment. A person who follows a valid link and creates an account within 30 days may be attributed to that affiliate. If more than one valid affiliate link is followed, the most recent valid link receives attribution.

Attribution depends on ordinary website tracking. Deleted browser storage, privacy settings, another device, an expired period or technical interruptions may prevent attribution. We will consider reasonable evidence of an error but cannot guarantee manual attribution.

4. Eligible commission

Commission is 20% of eligible membership revenue actually received and retained during the referred member’s first membership year, after discounts and refunds and excluding GST. PayPal fees do not reduce the commission base unless disclosed before the referral.

A yearly membership earns commission on its eligible first-year payment only. Monthly commission is based on eligible monthly payments received during the first 12 months. Renewals or payments for a later membership year do not earn commission.

5. Commission timing and statuses

Yearly commission remains pending until the 14-day first-payment refund period passes. Monthly commission remains pending until the referred member completes 12 months of paid membership. After eligibility checks, the amount becomes Ready to pay.

• Pending: eligibility, payment or the waiting period is incomplete.
• Ready to pay: the amount has qualified and awaits payout.
• Paid: the payout has been recorded as sent.

6. Refunds, reversals and cancellations

No commission is earned on an unpaid, refunded, reversed, charged-back, fraudulent or invalid transaction. Refunds and reversals reduce the commission base and may cancel or recalculate a pending amount. If related commission was already paid, the adjustment may be deducted from a future payout after details are provided.

Cancellation does not remove commission already earned on amounts properly paid and retained, but no commission accrues on payments that are not received.

7. Self-referrals and improper activity

You must not use your link for your own membership, refer an account you control, arrange reciprocal referrals, create false accounts, manipulate tracking or generate transactions without a genuine new customer. We may review reasonable indicators of duplicate or controlled accounts. Improper referrals may be rejected and related commission reversed.

8. Disclosure and promotion rules

Every promotion must clearly and prominently disclose the commercial relationship before a person follows the link or buys. You may use: “I may earn a commission if you join Empowered Maths through this link, at no extra cost to you.” Use platform disclosure tools where available.

You must be truthful and must not make misleading claims, promise unauthorised prices or bonuses, send spam, use unlawful or offensive promotion, bid on our brand names in paid search without permission, imitate our brand through domains or accounts, place links on coupon or file-sharing services without permission, or claim to be our employee or official representative.

9. Brand and intellectual property

You receive a limited, revocable, non-exclusive and non-transferable permission to use approved Empowered Maths names, links and promotional material only for the program. Ownership remains with us. You must not alter logos, remove copyright notices, distribute protected teaching resources or create material that could be mistaken for an official publication.

10. Dashboard information and privacy

The dashboard provides privacy-limited referral and commission information. It is confidential and may be used only to understand your affiliate activity. You must not attempt to identify, contact, target or disclose a referred member using dashboard information unless you independently have a lawful basis.

11. Payouts and payment details

You must maintain a valid PayPal email. Ready-to-pay amounts are reviewed and paid manually in AUD through our regular payout process. You are responsible for PayPal availability, receiving-account charges and correct details. If payment fails, the amount remains recorded while corrected details are requested.

Contact us promptly if you believe a dashboard status or amount is incorrect.

12. Tax responsibilities

You are responsible for your income tax, GST, invoicing, reporting and other obligations relating to affiliate payments. If you are registered for GST and your commission supply is taxable, contact us before payout so appropriate documentation and payment treatment can be arranged.

13. Suspension and termination

You may leave by contacting us. We may suspend tracking or payouts while reasonably investigating suspected fraud, misleading promotion, security issues or a material breach. We may terminate participation for a material or repeated breach after notice and, where appropriate, an opportunity to respond or correct it.

Valid commission earned before termination remains payable subject to refunds, fraud checks and these terms. Permission to use our brand and link ends when participation ends.

14. Changes, liability and general terms

We may update the program or these terms with reasonable notice of a material change. A change will not retrospectively remove commission already earned, and you may leave before it takes effect.

We take reasonable care but cannot guarantee uninterrupted tracking, website or PayPal availability. Nothing excludes a right or remedy that cannot legally be excluded. To the extent permitted by law, neither party is liable for indirect or consequential loss that was not reasonably foreseeable.

You may not transfer your affiliate account without written permission. If part of these terms is unenforceable, the remaining terms continue. A delay in enforcement is not a waiver.

15. Governing law and contact

These terms are governed by the laws of New South Wales, Australia. You and we submit to courts and tribunals with jurisdiction under those laws.
