Membership Terms and Conditions

1. About these terms

These terms apply when you create an Empowered Maths account or purchase an Empowered Maths membership from Katrina Mardell (we, us or our). By purchasing a membership, you agree to these terms. You must be at least 18 years old and able to enter a contract.

2. Membership plans and prices

We currently offer a monthly membership for $9 AUD and a yearly membership for $88 AUD. Prices are shown in Australian dollars. Any taxes that must be included by law will be included in the displayed price.

Your membership renews automatically at the end of each billing period unless you cancel it before the next payment is taken. We will clearly show the price, billing period and renewal arrangement before you approve payment.

3. Payment

Payments and recurring subscriptions are processed by PayPal. Your use of PayPal is also subject to PayPal’s applicable terms and privacy practices. You authorise PayPal to charge the selected membership amount at each renewal until the subscription is cancelled.

If a payment fails or is reversed, access may be paused while the payment issue is resolved.

4. Member access

An active paid membership gives you access to all locked Empowered Maths member resources made available in the member library. We may add, update, replace or retire individual resources as the library develops. We will not remove your access to the member library during a period you have already paid for without providing an appropriate remedy.

Your account is for one member. Keep your password private and tell us promptly if you believe someone else has used your account. You are responsible for keeping your email address current so that you can receive verification, password reset, billing and service messages.

5. Educational resource licence

Your membership gives you a limited, non-exclusive and non-transferable licence to use downloaded resources for your own teaching or home education. You may print and use resources with the students you personally teach or children in your household.

You must not share your login, resell or redistribute files, upload resources to a public or shared file library, remove branding, claim the resources as your own, or use them to create a competing product. See our Copyright and Permitted Classroom Use page for details.

6. Refunds

The first payment for either a monthly or yearly membership has a 14-day refund period. To request a refund, contact us within 14 days of that first payment and include the email address used for your membership.

Requests made after the first-payment period are considered under our Refund and Cancellation Policy. Nothing in these terms excludes or limits any right or remedy you have under the Australian Consumer Law or another law that cannot legally be excluded.

7. Cancelling your membership

You may cancel at any time through the available PayPal subscription controls or by contacting us. Cancellation stops future renewal payments. Unless a refund or legal remedy applies, you will keep member access until the end of the period you have already paid for, and no further payment will be taken.

8. Account suspension or closure

We may suspend or close an account if there is payment fraud, serious misuse of the website, unlawful activity, sharing or redistribution of protected resources, or another material breach of these terms. Where reasonable, we will explain the issue and provide an opportunity to correct it before closing access.

9. Website availability

We aim to keep the website and member library available, but short interruptions may occur for maintenance, updates or matters outside our reasonable control. If a significant interruption prevents you from using a paid service, contact us so we can consider an appropriate remedy.

10. Australian Consumer Law

Our services come with consumer guarantees that cannot be excluded under the Australian Consumer Law. These terms do not change those rights. Where the law allows us to limit liability, our liability is limited only to the extent permitted by law.

11. Changes to these terms or prices

We may update these terms to reflect changes to the membership, the law or our business. If a change materially affects an active membership, we will give reasonable notice before it takes effect.

If Empowered Maths becomes registered for GST, membership prices may increase to include the applicable GST. For example, a GST-exclusive price may increase by the GST required by law. We will tell affected members the new GST-inclusive price before it applies.

Any new price, including a GST-related increase, will apply only to a future renewal after reasonable advance notice. It will not be charged retrospectively. You may cancel before the renewal date to avoid the higher renewal price, and your existing access will continue until the end of the period already paid for.

12. Governing law

These terms are governed by the laws of New South Wales, Australia. You and we submit to the courts and tribunals that have jurisdiction under those laws.
